Handicraft and entertainment objects based on pyrotechnic mixtures can be sold to individuals and can be used in public by them only during the periods provided by law and methodological rules, as follows:
The sale of pyrotechnic articles from categories 1 and P1 can be done only under the conditions of observing the provisions of Law no. 126/1995 on the regime of explosives, with subsequent amendments and completions;
firecrackersPyrotechnic articles may be sold only in spaces intended for the sale of such items only after obtaining authorization to own and sell them from the Territorial Labor Inspectorate and the County Police Inspectorate / Bucharest General Police Directorate and after obtaining the agreement of the inspectorate unit for situations emergency in whose area of competence it operates;
Pyrotechnic articles are stored in rooms constructed as follows:
In buildings with commercial spaces in the trading rooms, only pyrotechnic articles of categories 1 and P1, up to a gross weight of 100 kg;
in a room adjacent to the commercial space which does not serve for continuous living by persons, only pyrotechnic articles of categories 1 and P1, up to a gross weight of 500 kg;
In uninhabited buildings located in populated areas or in a storage room of a building used exclusively for industrial purposes, it is permissible to store pyrotechnic articles of categories 1 and P1, up to a gross weight of 1000 kg.
Quantities higher than those provided for in the previous paragraph and pyrotechnic articles of categories 2,3,4, P2, T1, and T2 shall be kept only in warehouses of authorized pyrotechnic articles;
The sale of pyrotechnic articles is made only by legal entities authorized for this purpose and only in places authorized under the law; the spaces for the sale of pyrotechnic articles will be arranged outside the residential buildings;
Category 1 pyrotechnic articles may not be sold or otherwise made available to consumers under the age of 16;
Manufacturers, importers, and distributors may not sell pyrotechnic articles of categories 2, 3, and 4, stage pyrotechnic articles, other pyrotechnic articles of category P2, nor may they make them available in any way to any person other than pyrotechnicians;
The spaces/constructions intended for the storage/sale of pyrotechnic articles must meet the conditions provided in annex no. 1 hereof.
CONDITIONS REGARDING THE USE OF CRAFT OBJECTS
OF DISTRACTION BASED ON PYROTECHNIC MIXTURES
The use of pyrotechnic articles is prohibited in the following situations:
between 24.00 and 6.00, except for authorized periods, as well as events of local, national, or international interest, based on the approval of local authorities;
at a distance of fewer than 50 meters from housing constructions with up to 4 levels and less than 100 m from those with more than 4 levels;
at a distance of fewer than 500 m from high voltage electrical installations, from places of storage and delivery of liquid or solid fuels, from gas installations;
at a distance less than that provided by the regulations in force for chemical and petrochemical objectives or for other objectives that present a fire or explosion hazard;
in places where there is a risk of landslides, avalanches, or falls;
on public roads open to road traffic, on pedestrian alleys, and in open spaces with crowds of people;
at a distance of fewer than 500 m from forests.
According to Order no. 125/1378/2013 on the establishment of activities, other than civil aeronautical activities, having as the effect the arrival in the airspace of various material bodies that may constitute a danger to aviation safety and on the approval of the conditions for authorization of these activities, the launch in the airspace of articles Pyrotechnic articles classified, according to specific regulations, in categories 2, 3 or 4 may, under certain conditions, constitute a danger to aviation safety. In this context, it is necessary to obtain an authorization from the Romanian Civil Aeronautical Authority.
According to the provisions of art. 5 of H.G.R. no. 95/2011, pyrotechnic articles of categories 2, 3, 4, T1, T2, and P2 may be used only by pyrotechnicians and only for the purpose for which they are intended.
The organization of games with pyrotechnic entertainment articles from categories 3 and 4 is allowed only under the conditions of the City Hall, the County Emergency Inspectorate / Bucharest-Ilfov, and the approval of the County Police Inspectorate, respectively of the General Police Directorate of the Municipality Bucharest, on whose radius the respective games are executed.
